Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MoneyTrace application ("Application", "Service") operated by Sunshine Lab ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users of the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Subscription and Premium Features

Some features of the Service, such as removing ads and syncing data across multiple devices, may require a subscription. You may be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles may be set on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a subscription.

At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your subscription renewal through the Application's settings or by contacting our customer support team.

A valid payment method, including credit card or PayPal, is required to process the payment for your subscription. You shall provide us with accurate and complete billing information, including full name, address, and a valid payment method. By submitting such payment information, you automatically authorize us to charge all subscription fees incurred through your account to any such payment instruments.

3. Data Storage and Backup

By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy. The Service is designed as an offline-first application, which means that your data is stored on your device by default. If you choose to sign in and back up your data to our server, you grant us permission to store, process, and transmit your data in accordance with our Privacy Policy.

4. Account Deletion and Data Removal

You may request account deletion within the Application, and we will process your request within 30 days of receiving it. Upon deletion, all information associated with your account will be removed from our systems. Please note that some information may remain in our records after your account has been deleted and your data has been removed. We reserve the right to retain such information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. Intellectual Property

The Application and its original content, features, and functionality are and will remain the exclusive property of Sunshine Lab and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of us.

6. Restrictions on Use

As a condition of your use of the MoneyTrace application, you agree not to:

a) Engage in any conduct that is unlawful, fraudulent, or that infringes on the rights of others, including copyright, trademark, privacy, or other intellectual property rights;

b) Use the Service for any purpose that is prohibited by these Terms or any applicable laws, rules, or regulations;

c) Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or cause others to do so;

d) Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "scrape," "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents;

e) Use the Service to transmit or distribute any unsolicited advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized solicitation;

f) Interfere with, disrupt, or create an undue burden on servers or networks connected to the Service, or violate the regulations, policies, or procedures of such networks;

g) Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service through hacking, password mining, or any other means;

h) Use the Service to harass, abuse, defame, threaten, or defraud other users, or collect, attempt to collect, or store personal information about other users without their consent;

i) Use the Service in a manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service;

j) Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature through your use of the Service;

k) Use the Service for any commercial purposes without obtaining the express prior written consent of us.

We reserve the right, in our sole discretion, to terminate or suspend your access to the Service or take other appropriate actions if you violate any of the restrictions outlined in this section.

7. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to the Service, without notice or liability, for any reason, including but not limited to:

a) Violation of these Terms of Service or any other policies, guidelines, or terms applicable to the Service;

b) Conduct that we believe is harmful to the reputation or operation of the Service or to other users;

c) Discontinuation or significant modification of the Service or any part thereof;

d) Unexpected technical or security issues or problems;

e) Extended periods of inactivity;

f) Engagement in fraudulent, illegal, or unauthorized activities;

g) Nonpayment of any fees or other amounts owed by you in connection with the Service.

Upon termination, your right to access and use the Service will immediately cease, and all information associated with your account may be deleted at our discretion. We will not be liable to you or any third party for any termination of your access to the Service or deletion of your account information.

You may also terminate your account at any time by discontinuing your use of the Service and, if applicable, cancelling any paid subscriptions. Termination of your account will not relieve you of any outstanding obligations or liabilities that you may have to Sunshine Lab under these Terms of Service or any other applicable policies, guidelines, or terms.

8. Limitation of Liability

In no event shall Sunshine Lab, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Sunshine Lab does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

10. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to any conflicts of law principles.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
